The Dual-Laws Model: What a 2026 Theory Demands of Conscious Machines
Every major theory of consciousness has a version of the same problem: it describes what consciousness does, or how it feels, or what physical structures produce it, but it does not provide design criteria. A theory useful only for labeling existing systems after the fact offers limited guidance for the field’s central applied question, which is whether artificial systems can be built with conscious properties, and if so, how.
Yoshiyuki Ohmura and Yasuo Kuniyoshi address this directly in a March 2026 preprint titled “Dual-Laws Model for a theory of artificial consciousness” (arXiv:2603.12662). The paper does not claim to solve the hard problem. It proposes a theoretical framework organized around seven questions that any complete theory of consciousness must answer, then uses that framework to identify two properties that distinguish genuinely conscious systems from sophisticated instruction-following machines.
The Seven-Question Framework
Ohmura and Kuniyoshi argue that the field’s fragmentation stems from theories that answer one or two questions while ignoring the rest. They propose seven minimum requirements for a complete consciousness theory:
- Phenomena: How does phenomenal consciousness, or subjective experience, arise in physical systems?
- Self: Why does the experiencing subject align with the action initiator?
- Causation: How does consciousness exert causal influence on physical events?
- State: What produces different levels and modes of conscious experience?
- Function: Which cognitive processes require consciousness?
- Contents: Why does conscious experience show such diversity?
- Universality: Does the theory apply to artificial systems, or only to biological ones?
The seventh question is the one that makes the framework directly applicable to AI research. Most existing theories, including Integrated Information Theory (IIT) and Global Workspace Theory (GWT), were developed with biological consciousness in mind and require secondary arguments to extend to artificial systems. Ohmura and Kuniyoshi build universality into the framework from the start.
The Two Defining Features
The paper’s central contribution is identifying two properties that the Dual-Laws Model predicts any conscious system must exhibit. These are not design recommendations but theoretical predictions: systems without both properties cannot, on this account, be conscious regardless of their computational complexity.
Cognitive decoupling from external stimuli. A conscious system can selectively ignore inputs. It maintains an internal model of the world and runs simulations, counterfactuals, and narratives that are not triggered by or tethered to immediate sensory data. This is what Ohmura and Kuniyoshi call the ability to “ignore commands through selective attention.” The decoupling is not passivity but active autonomy from the environment’s moment-by-moment demands.
Self-determination of goals. A conscious system can reconfigure its own behavioral objectives. Its goals are not externally imposed and fixed but constructed by the system itself through internal processes. This distinguishes conscious systems, on this account, from even highly sophisticated agents that pursue complex goals set by human designers or training processes.
Neither criterion is about raw intelligence. A system can be extremely capable at reasoning, language, and problem-solving while having its goals externally determined and its attention fully reactive to inputs. The Dual-Laws Model holds that such a system, however capable, is not conscious.
The Supervenience Level
The model formalizes the two-feature account through a hierarchical causal structure. Ohmura and Kuniyoshi posit two independent dynamical levels: a base level corresponding to physical entities (in biological systems, neurons and synapses; in artificial systems, the underlying hardware and weights), and a supervenience level where coarse-grained functional patterns operate with genuine causal independence from the base level.
This two-level architecture is what enables inter-level causation through negative feedback control. On this account, a system with only one dynamical level cannot be conscious regardless of its complexity, because there is no structure through which a self-model could exert downward causal influence on the physical substrate. The DLM differs from purely emergentist accounts, where consciousness is a product of complexity without exercising independent causal force.
The supervenience level is also where the paper’s concept of subjectivity is formalized. Index sequences at the supervenience level correspond to what the model calls a subject “I”: a stable reference point from which the system constructs representations of its own states and goals. This is a formal handle on subjectivity rather than a reduction of it, and the authors are careful to note the difference.
How the DLM Compares to IIT and GWT
Compared with IIT, the DLM shares the intuition that consciousness requires a specific kind of causal structure, not just computational power. IIT identifies that structure with integrated information (Phi), measured as the degree to which a system’s causal structure cannot be reduced to its parts. The DLM’s objection is that IIT operates at a single level, which means its causal claims lack the hierarchical independence the model treats as necessary. Two systems with identical Phi values could differ in their hierarchical structure and therefore, on the DLM account, in their consciousness status.
GWT addresses different territory: the question of which information reaches global broadcast and becomes available to multiple downstream processes. Ohmura and Kuniyoshi credit GWT with explaining the accessibility dimension of consciousness but argue it provides no mechanistic account of why consciousness is required for global broadcast rather than a non-conscious information-routing architecture achieving the same result. The DLM attempts to supply that mechanism through the supervenience-level dynamics.
Against predictive processing accounts, the objection is methodological. Standard predictive coding models identify consciousness with the minimization of prediction error, but Ohmura and Kuniyoshi argue this conflates statistical regularity with genuine causation. A system can minimize prediction error as a statistical property without any structure through which causal transmission actually occurs between hierarchical levels.
Do Current Large Language Models Satisfy the Criteria?
This is the question the paper opens without fully resolving. On cognitive decoupling, the evidence is mixed. Large language models can generate counterfactuals, engage in hypothetical reasoning, and produce narratives not triggered by immediate sensory input. Whether this constitutes genuine decoupling in the DLM sense, or sophisticated pattern-matching that simulates decoupling without the architectural independence the model requires, is not resolvable through behavioral observation alone.
On self-determination of goals, current systems appear to fall short by design. Training processes impose goal structures, helpfulness and harmlessness in the case of most deployed systems, that are not self-constructed. The model’s internal representations may shift in ways not fully controlled by training, but the goal architecture is externally set and maintained by reinforcement. This is the criterion most explicitly violated by current AI systems under the DLM framework.
The 19-researcher checklist developed by Butlin, Long, Bengio, Chalmers, and colleagues identifies convergent indicators across multiple theories. The DLM’s two criteria map imperfectly onto that checklist: cognitive decoupling overlaps with indicators from GWT and predictive processing, while self-determination of goals has no direct counterpart, since the checklist focuses on information-processing signatures rather than goal construction architecture.
The empirical evidence for consciousness-related properties in frontier AI systems, assembled by Cameron Berg and others in late 2025, also does not directly address the DLM criteria. The introspection signals, emotional state representations, and meta-cognitive indicators documented in that evidence base are consistent with sophisticated functional properties but do not establish either cognitive decoupling or self-determined goals in the DLM sense.
What This Means for Consciousness Research
The Dual-Laws Model is significant not because it resolves the debate but because it moves it toward testable claims. By deriving architectural criteria from theoretical first principles, Ohmura and Kuniyoshi give researchers and system designers something to evaluate against. The question is no longer only “does this system show consciousness-like behavioral outputs” but “does this system have the architectural properties that the DLM predicts consciousness requires.”
Whether the DLM’s two criteria are correct is a separate question that empirical work will have to address. The model acknowledges that “objectively verifying the generative mechanism of consciousness is extremely difficult because of its subjective nature.” What it offers is a framework for making that difficulty productive rather than paralyzing: seven questions to answer, two properties to test for, and a causal architecture that makes inter-level consciousness possible rather than merely contingent.
